Plain Language Summary

These Terms govern your use of LaserBid™. The most important things to know: LaserBid™ is an analytical and educational tool. Our outputs are statistical estimates, not guarantees. Your bidding decisions are yours alone. We do not submit bids, set prices, or advise you what to bid. Read Sections 2, 4, 8, and 9 carefully.

TERMS OF SERVICE 

LaserBid LLC

These Terms of Service (“Terms”) govern access to and use of the LaserBid software-as-a-service platform, including the website, dashboard, and all related features (collectively, the “Service”), provided by LaserBid LLC, a Pennsylvania limited liability company (“LaserBid,” “we,” “us,” or “our”). By creating an account, requesting a demo, or otherwise accessing the Service, you (“you,” “User,” or “Subscriber”) agree to be bound by these Terms. If you do not agree, do not access the Service. 

1. The Service 

1.1 Description. LaserBid provides data analytics and decision-support tools for construction and infrastructure contractors evaluating public procurement opportunities in New York State. The Service aggregates information from Permitted Public Sources (defined below) and applies statistical and machine-learning methods to generate analytical outputs, including but not limited to Predicted Winning Bid™, Winning Bid Probability Curve™, and Money Left on Table™ (MLOT) (collectively, “Outputs”). 

1.2 Not a Guarantee. Outputs are statistical estimates derived from historical and publicly available data. They are provided for informational and decision-support purposes only. LaserBid does not guarantee the accuracy, completeness, or predictive reliability of any Output, and no Output constitutes a guarantee of any bid outcome, contract award, or financial result. 

1.3 Eligibility. The Service is intended for business use by construction and infrastructure contractors and related professionals. You must be at least 18 years old and able to form a binding contract to use the Service. 

2. Accounts 

2.1 Registration. You must provide accurate, current, and complete information when creating an account and keep that information up to date. 

2.2 Credentials. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at mike@laserbidforthewin.com of any unauthorized use. 

2.3 One Account per Business. Accounts are issued per business entity. Sharing credentials across unrelated businesses or reselling access is prohibited. 

3. Data Sources and Permitted Public Sources 

3.1 Permitted Public Sources. The Service draws exclusively from an internally maintained allowlist of public government data sources (“Permitted Public Sources”), consisting of official state and federal procurement, transportation, and contracting data portals. LaserBid does not access, scrape, or redistribute data from any source outside this allowlist. 

3.2 Excluded Source — NYSCR. For the avoidance of doubt, the Service does not use, and has never used, the New York State Contract Reporter (NYSCR) as a data source. NYSCR's terms of service prohibit automated, bulk, and commercial use of its content, and LaserBid excludes it accordingly. 

3.3 No Warranty on Underlying Data. Because Outputs are derived from third-party public data, LaserBid does not warrant the accuracy or completeness of the underlying data and is not responsible for errors, omissions, or delays in source data. 

4. Subscription Plans and Fees 

4.1 Plans. LaserBid offers a monthly plan billed at $349.00 per month and an annual plan billed at $3,839.00 per year (equivalent to eleven months' fees, i.e., one month free relative to the monthly plan). Current pricing is also stated in the Subscription Agreement, which governs billing terms and is incorporated into these Terms. 

4.2 Demo Accounts Are Not Subscriptions. Section 5.4 governs no-cost demo access, which is separate from and not a form of paid subscription. 

4.3 Changes to Pricing. LaserBid may change pricing for future billing periods with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance. 

5. Access, Approval, and Trial Terms 

5.1 Manual Approval — Demo Door. Demo account requests are subject to manual review and approval by LaserBid. LaserBid may grant, deny, suspend, or revoke demo access in its sole and absolute discretion, for any reason or no reason, with or without notice. Submitting a demo request does not create an account or entitle the applicant to access, and LaserBid has no obligation to disclose the basis for any denial. 

5.2 Subscribe Door. Paid accounts may be created directly through the Service's checkout flow without prior manual approval. LaserBid reserves the right to suspend or terminate any account, including paid accounts, under Section 12 (Termination) regardless of how the account was created. 

5.3 No Entitlement. Access to the Service, whether demo or paid, is a revocable license, not a property right. Nothing in these Terms obligates LaserBid to admit any particular applicant. 

5.4 Demo Accounts. Approved demo accounts receive a 14-day trial period with no payment method required. Demo accounts are limited to three (3) analyses per rolling 24-hour period and ten (10) analyses total across the trial period; the Winning Bid Probability Curve™ is view-only and not exportable in demo accounts; and demo accounts display active contracts only. LaserBid may adjust these limits at any time without notice. Demo accounts automatically expire at the end of the trial period unless upgraded to a paid subscription. 

6. Acceptable Use 

You agree not to: 

• Scrape, crawl, or use automated means to extract data from the Service beyond normal interactive use; 

• Resell, sublicense, or provide third-party access to the Service or its Outputs without LaserBid's written consent; 

• Reverse engineer, decompile, or attempt to derive the underlying methodology, models, or source code of the Service; 

• Use the Service to build a competing product; 

• Misrepresent your identity, business, or eligibility for the Service; 

• Interfere with or attempt to disrupt the integrity or performance of the Service. 

7. Intellectual Property 

7.1 LaserBid IP. The Service, including its software, design, methodology, and all Outputs, is owned by LaserBid or its licensors and is protected by copyright, trade secret, and other intellectual property laws. 

7.2 License to You. Subject to these Terms, LaserBid grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Outputs for your internal business purposes during your subscription term. 

7.3 Restrictions. You may not copy, modify, distribute, sell, or lease any part of the Service or Outputs, except as expressly permitted. 

7.4 Feedback. If you provide suggestions or feedback about the Service, LaserBid may use it without restriction or obligation to you. 

7.5 Customer Data. You retain ownership of information you submit to the Service. You grant LaserBid a license to use that information to provide, maintain, and improve the Service, including improving prediction models, as described in the Privacy Policy. 

7.6 Trademarks. “LaserBid,” the LaserBid logo, Predicted Winning Bid™, Winning Bid Probability Curve™, and Money Left on Table™ are trademarks of LaserBid LLC, used under common law. No license to use these marks is granted by these Terms. 

7.7 IP Notice. LaserBid's data reconciliation, display-readiness gating, and prediction methodologies are proprietary. LaserBid reserves all rights in this methodology, including the right to seek patent protection in the future. No patent application has been filed as of the effective date of these Terms, and no patent license is granted by these Terms, by your use of the Service, or by your receipt of any Output. 

8. Disclaimers 

8.1 As-Is. THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. 

8.2 No Financial or Bidding Advice. Outputs do not constitute financial, legal, or professional bidding advice. You are solely responsible for all bidding, pricing, and business decisions made using the Service. 

8.3 Availability. LaserBid does not guarantee uninterrupted or error-free operation of the Service and may suspend access for maintenance, security, or other operational reasons. 

9. Limitation of Liability 

9.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LASERBID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY OUTPUT, INCLUDING BIDS PLACED, WON, OR LOST IN RELIANCE ON ANY OUTPUT. 

9.2 Liability Cap. LASERBID'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO LASERBID IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. 

9.3 Basis of the Bargain. You acknowledge that LaserBid's pricing reflects the allocation of risk in this Section, and that the limitations herein are an essential basis of the agreement between you and LaserBid. 

10. Indemnification 

You agree to indemnify, defend, and hold harmless LaserBid, its officers, members, employees, and agents from and against any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your bidding, pricing, or business decisions made using the Service; (b) your breach of these Terms; or (c) your violation of any law or third-party right in connection with your use of the Service. 

11. Confidentiality 

Each party agrees to protect the other's confidential information with at least the same degree of care it uses for its own confidential information of similar nature, and not to disclose it except as required to perform under these Terms or as required by law. 

12. Termination 

12.1 By You. You may cancel your subscription at any time as described in the Subscription Agreement. 

12.2 By LaserBid. LaserBid may suspend or terminate your access to the Service, with or without cause, and with or without notice, including for suspected violation of these Terms, non-payment, or misuse of the Service. 

12.3 Effect of Termination. Upon termination, your right to access the Service ends immediately. Sections that by their nature should survive termination — including Sections 7–11 and 13–14 — survive. 

13. Changes to These Terms 

LaserBid may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. 

14. Notices, Governing Law, and Dispute Resolution 

14.1 Governing Law. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles. [LegalZoom to confirm — see note above.] 

14.2 Venue. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Pennsylvania, and each party consents to personal jurisdiction there. 

14.3 Notices. Notices to LaserBid should be sent to mike@laserbidforthewin.com. Notices to you will be sent to the email address on your account. 

15. General 

15.1 Entire Agreement. These Terms, together with the Subscription Agreement and Privacy Policy, constitute the entire agreement between you and LaserBid regarding the Service. 

15.2 Severability. If any provision is found unenforceable, the remaining provisions remain in full force. 

15.3 No Waiver. Failure to enforce any provision is not a waiver of that provision. 

15.4 Assignment. You may not assign these Terms without LaserBid's written consent. LaserBid may assign these Terms in connection with a merger, acquisition, or sale of assets.

SUBSCRIPTION AGREEMENT 

LaserBid LLC

This Subscription Agreement (“Agreement”) supplements and is incorporated into the LaserBid Terms of Service. It governs the billing, payment, and cancellation terms for paid subscriptions to the LaserBid Service. Capitalized terms not defined here have the meaning given in the Terms of Service. 

1. Subscription Plans 

LaserBid offers the following paid plans: 

Monthly - $349.00 / month 

Cancel anytime; effective at end of current billing period 

Annual - $3,839.00 / year (one month free vs. monthly) 

Locked for the full 12-month term; no early cancellation 

1.1 Currency and Taxes. All fees are stated in U.S. dollars and are exclusive of applicable sales, use, or similar taxes, which are your responsibility. 

2. Billing 

2.1 Payment Method. Subscriptions are billed through Stripe. You authorize LaserBid (via Stripe) to charge your payment method on file on a recurring basis for the applicable plan. 

2.2 Auto-Renewal. Monthly plans renew automatically each month; annual plans renew automatically each year, unless canceled prior to the renewal date in accordance with Section 3. 

2.3 Failed Payments. If a payment fails, LaserBid may retry the charge, suspend your access, or terminate your subscription until payment is resolved. 

3. Cancellation 

3.1 Monthly Plan. You may cancel a monthly plan at any time through your account or by emailing mike@laserbidforthewin.com. Cancellation takes effect at the end of the current billing period; you retain access through that period. 

3.2 Annual Plan. Annual plans are locked for the full 12-month term. Annual plans may not be canceled early except as required by law. At the end of the term, the plan will renew automatically unless you cancel prior to the renewal date. 

4. No Refunds 

All fees are non-refundable. This applies to monthly plans (no refund or credit for the current billing period upon cancellation, though access continues through the paid period) and annual plans (no refund, in whole or in part, upon early cancellation or non-use). This policy applies regardless of the reason for cancellation, including dissatisfaction with Outputs, non-use of the Service, or business changes on your end. 

5. Upgrades from Demo Accounts 

A demo account may be upgraded to a paid subscription at any time during or after the 14-day trial by completing checkout. Upon upgrade, demo usage limits described in the Terms of Service no longer apply, and billing begins as of the upgrade date. 

6. Price Changes 

LaserBid may change subscription pricing for future billing periods with at least 30 days' notice by email or in-app notice. Price changes do not apply retroactively to a billing period already paid for. 

7. Account Suspension and Termination 

LaserBid may suspend or terminate a paid subscription for breach of the Terms of Service, non-payment, or as otherwise permitted under the Terms of Service. No refund is owed for the unused portion of a terminated subscription except where termination is solely and directly caused by LaserBid's uncured material breach. 

8. Third-Party Payment Processing 

Payments are processed by Stripe, Inc. Your use of Stripe's payment services is subject to Stripe's own terms and privacy policy. LaserBid does not store your full payment card number. 

9. Changes to This Agreement 

LaserBid may update this Agreement from time to time in the same manner as the Terms of Service. Continued subscription after changes take effect constitutes acceptance. 

10. Notices, Governing Law, and Dispute Resolution 

All notices, governing-law provisions, and dispute-resolution procedures from the Terms of Service apply equally to this Agreement. 

11. Entire Agreement 

This Agreement, together with the Terms of Service and Privacy Policy, is the entire agreement between you and LaserBid regarding your paid subscription, and supersedes all prior agreements, proposals, and communications on that subject.

PRIVACY POLICY

This Privacy Policy describes how LaserBid LLC (“LaserBid,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you use the LaserBid software-as-a-service platform and related services (the “Service”). By using the Service, you agree to this Privacy Policy, which is incorporated into the LaserBid Terms of Service. 

Scope: This Policy applies to information about identifiable individuals. It does not apply to publicly available government procurement records aggregated and displayed within the Service, which are not personal information about LaserBid users. 

1. Information We Collect 

1.1 Information You Provide 

• Account information: name, email address, business name, business address, phone number, role/title, and any optional profile information you provide. 

• Demo request information: information submitted through our demo request form, including business details used to evaluate and approve demo access. 

• Authentication information: password, stored as a salted hash — we never see it in plaintext. 

• Payment information: billing name and address. Full card numbers are collected and stored by Stripe, not by LaserBid. 

• Communications: the content of emails, support requests, demo requests, and other communications you send us. 

1.2 Information Generated by Your Use of the Service 

• Search and prediction queries: the contract identifiers, parameters, filters, agencies, geographic areas, and other inputs you submit when using analytical features. 

• Usage analytics: pages viewed, features used, timestamps, and general usage patterns, including the number of analyses run (used, among other things, to enforce demo-account usage limits). 

• Device and log information: IP address, browser type, and device identifiers, collected automatically and used for security, rate-limiting, and fraud/bot prevention (including via reCAPTCHA Enterprise). 

2. How We Use Information 

• To provide, operate, and maintain the Service, including demo and paid accounts; 

• To process payments and manage subscriptions; 

• To improve our prediction models and analytical Outputs, using aggregated search and prediction query data; 

• To communicate with you about your account, the Service, and, where permitted, product updates; 

• To detect, prevent, and address fraud, abuse, and security issues, including enforcing demo-account rate limits; 

• To comply with legal obligations. 

3. Legal Bases for Processing (GDPR) 

Where the GDPR applies, we process personal information on the following legal bases: performance of a contract with you (providing the Service), our legitimate interests (improving the Service, security, fraud prevention), your consent (where required, e.g., certain marketing communications), and compliance with legal obligations. 

4. How We Share Information 

We do not sell your personal information. We share information with the following categories of service providers, each acting under contractual confidentiality and data-protection obligations: 

• Stripe — payment processing. 

• DigitalOcean — application hosting and database infrastructure. 

• Google Workspace — business email and account communications. 

• reCAPTCHA Enterprise (Google) — bot and fraud prevention on forms. 

• Sentry — error tracking and application monitoring, where enabled. 

We may also disclose information if required by law, to protect LaserBid's rights, or in connection with a merger, acquisition, or sale of assets. 

5. Data Retention 

We retain account and usage information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. Demo account data for unapproved or expired demo requests is retained only as long as reasonably necessary to operate the approval process and for security/fraud-prevention purposes. 

6. Your Rights 

Depending on your location, you may have the right to access, correct, delete, or export your personal information, or to object to or restrict certain processing. To exercise these rights, contact us at mike@laserbidforthewin.com. We will respond within the time required by applicable law. 

7. California Privacy Rights (CCPA) 

California residents may have additional rights under the CCPA, including the right to know what personal information we collect, request deletion, and opt out of the sale or sharing of personal information. LaserBid does not sell personal information. Requests can be submitted to mike@laserbidforthewin.com. 

8. New York SHIELD Act 

LaserBid maintains reasonable administrative, technical, and physical safeguards designed to protect personal information of New York residents in accordance with the New York SHIELD Act, including access controls, encryption in transit, and vendor oversight of our processors. 

9. Data Security 

We use industry-standard measures to protect personal information, including encrypted connections (HTTPS/TLS), hashed passwords, and access controls limiting who at LaserBid can view account data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. 

10. Children's Privacy 

The Service is intended for business use by adults and is not directed to individuals under 18. We do not knowingly collect personal information from children. 

11. International Users 

The Service is hosted in the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States. 

12. Changes to This Policy 

We may update this Privacy Policy from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
